Whether you found your life partner here in the person of a foreign citizen, whether you met abroad, or whether you, as a foreigner, have a residence or settlement permit in Hungary and want to live with your family members in Hungary, a long-term residence permit will be needed.

First of all, it is necessary to clarify: who is considered a family member, who can apply for a residence permit for the purpose of family reunification?

According to Hungarian legislation, only the spouse or, in the case of same-sex couples, the registered partner, and the minor child (also adopted) are family members. For siblings or direct relatives (parents, grandparents), the law only allows the submission of an application if it can be proven that they are unable to take care of themselves due to their health condition.

If you have a spouse of foreign nationality or are just planning to get married, the question arises:

IS IT NEEDED A RESIDENCE PERMIT TO STAY IN HUNGARY?

The answer depends on the nationality of your spouse or minor child.

A residence permit is not required, but in the event of a stay of more than 3 months, the spouse and the minor child must apply for a registration certificate card at the immigration police.

Information about submitting an application:

The application must be submitted in Hungary and the applicant will receive the card immediately upon submission of complete documents. Notifiable accommodation is also required, because the applicant will also receive a residential address card in addition to the registration certificate, which will be sent by post.

However, it is also necessary for the applicant to be able to prove how they will finance their living during their stay in Hungary. In the absence of proof of living, the authority will not issue the registration certificate card.

Working:

A spouse with a registration certificate can freely take up work in Hungary (the licence free employment must be reported to the employment office) and can also start an own business.

A third-country national family member may stay in Hungary for a long time only in possession of a residence permit for the purpose of family reunification.

Information about submitting an application:

If the applicant needs visa to travel to Hungary, in this case the family member must apply for a D visa and a residence permit for family reunification at the Hungarian consulate of the country of residence. In the case of a positive decision, the applicant will first receive a D visa, which is valid for 30 days from the date of entry, during which time it is necessary to collect the residence card from the competent immigration police.

If the third-country family member is not required to have a visa, he/she only needs to submit an application for a residence permit for the purpose of family reunification at the immigration police at the place of residence.

Notifiable accommodation is also required, the family member will not receive a residential address card, but only an accommodation registration form.

In all cases, it must be proven that the family can finance a living during their stay in Hungary, for example, proof of living can be provided by regular income or savings in a bank account.

Applications can only be submitted in person to the acting authority.

Working:

A spouse with a residence permit for the purpose of family reunification can work in Hungary, however, the family reunification permit is not sufficient in itself, it does not entitle him/her to work. If the family member has the possibility to work, this fact must be reported to the immigration police so that a consolidated work permit can be issued.

GOOD TO KNOW: A residence permit for the purpose of ensuring family reunification cannot be granted to a third-country national if the sponsor holds any of the following types of residence permits:

a) has not held a guest self-employment residence permit for at least one year,
b) seasonal employment residence permit,
c) residence permit issued for investment-based employment,
d) residence permit for employment purposes,
e) guest worker residence permit,
f) White Card,
g) residence permit for studies (including job seeking and business start-up),
h) residence permit for internship purposes,
i) residence permit for voluntary activities.

A residence permit must be issued to the child of a third-country national who is born in Hungary during the validity of the parent’s residence permit — even if no other third-country national may apply for a residence permit on the basis of that permit under this law.
